ACTION REQUIRED: New law effective July 9, 2018

On Tuesday, April 10, 2018, Westchester County Executive George Latimer signed the Wage History Anti-Discrimination Bill, which prohibits employers in Westchester County, New York from inquiring about a job applicant’s prior salary history. The bill will become law on Monday, July 9, 2018. 

What should you do now?

  • Remove any questions about previous salary history from any employment application
    (or similar document) used in your organization.
  • Train the members of your HR Department and anyone interviewing job applicants that they
    may not ask a job applicant about previous salary history at any time during the hiring process.  However, a prospective employer may, with the written consent of the prospective employee, confirm prior wage history when a prospective employee voluntarily discloses prior salary history to support a wage higher than the wage offered by the employer.
