Effective January 1, 2018, New York will implement the Paid Family Leave Law (“PFLL”) which will provide paid leave time for qualifying employees to bond with a newborn or newly placed adopted or foster child, to care for a qualifying family member with a serious health condition, and to assist family members who are deployed to active military service.

To assist employers in implementing the PFLL, the state has provided the following: forms for employees to complete to request leave, a form for employees to complete should they meet certain conditions and wish to waive their right to PFLL benefits, and forms for employers to complete if an employer wishes to voluntarily cover an employee under the PFLL though that employee is not entitled to such coverage. You can find the forms here: https://www.ny.gov/new-york-state-paid-family-leave/paid-family-leave-employer-and-employee-forms-0.

Employers may draft their own forms that comply with the requirements of the state-issued forms. However, the Partnership encourages the use of the state-issued forms.
