Pro Bono Partnership Child Care Initiative 

Evidence from studies of early childhood education programs suggest that good management and business practices, including legal compliance, are related to other measures of quality and child development outcomes.  The Partnership can provide assistance on general business legal needs and also on regulatory issues unique to child care providers. 

The Pro Bono Partnership, through its Child Care Initiative, provides legal advice and education to New York-based nonprofit child care and after-school providers, except those located in New York City.  We provide most assistance without charge.

Some of the areas where a provider may need legal advice and the Partnership can provide help include:

Employment

• Review/Update Personnel Policies and Job Descriptions;  
• Manage Employee Performance Issues;
• Implement Staff Reductions;
• Properly Classify Employees as Exempt or Non-Exempt from Wage and Hour Laws; and
• Properly Classify Workers as Employees or Independent Contractors.

Regulations

• Interpret and Assist with Compliance of Child Care Regulations and Statutes; and
• Help Establish Policies, Procedures and Documentation Required by the Office of Family and Children’s Services.

Parents

• Draft/Update Agreement with Parents; and
• Assist with Child Custody Issues that Involve the Center

Corporate Governance

• Update By-Laws and Certificate of Incorporation so they Accurately Reflect the Activities of the Center;
• Draft Policies Addressed in the New IRS Form 990; and
• Provide Guidance to the Board on its Roles and Responsibilities
